Private and Public International Law - European Law - International Relations

The Private International Law is the branch of law that aims to regulate the legal status and reports of individuals taken from an international perspective, as a member of international society. Like many authors, we would speak of Private International Law. A relationship is international when it involves a foreign element (extraneous), by contact with different legal systems.

This relationship will always be international whatever the authority which will have to rule on the law applicable to the dispute.

Example 1: (Divorce between an Italian and a French, married in France and settled in Spain)

Example 2: (A contract between a French importer and its American supplier based in Holland).

Public International Law is composed of all the rules of law that apply to subjects of international society: that is to say, the States, international organizations, and exceptionally individuals.

Public international law serves to reduce the anarchy in international relations by ensuring coexistence between states and trying to satisfy the common interests. International law is often an expression of power relations and convergence of interests between states.

The right of the European Union, according to Wikipedia, understands the rules of international law on which is based the European Union (EU) and the guidelines it issues. This includes all the rules, substantive and procedural, applicable within the European Union.

Before the entry into force of the Treaty of Lisbon on 1 December 2009, the law of the European Union included EU law (or law of the European Communities) and cooperation procedures such as foreign policy and security policy (CFSP ) and police and judicial co-operation in criminal matters (CPJP). After that date, the Treaty has abolished the pillar structure of the Union which has legal personality as heir Communities, hence the concept of Community law has become obsolete but still used to refer to the jurisprudence previous Tribunal

International relations are also called international studies. Under these terms, are usually designated the study of foreign affairs and major issues of the international system: the role of States, international organizations, non-governmental organizations (NGOs) and multinational companies.
